WASHINGTON: State extends rules for reporting COVID-19 outbreaks

The Washington Department of Labor and Industries (L&I) has issued a replacement emergency temporary rule, which is identical to the rule we previously reported, regarding employer reporting and notification requirements for infectious and contagious diseases during a public health emergency, including the COVID-19 (coronavirus) pandemic. The original rules were set to expire on December 8, 2021. L&I’s replacement rule took effect December 7, 2021, and will expire on April 6, 2022.

As a reminder, Washington employers with more than 50 employees must notify L&I within 24 hours of confirming that 10 or more employees at the worksite have tested positive for an infectious or contagious disease, including COVID-19. You must also provide written notice to exposed employees.
