
Now is a good time to review and update your employment posters. California employers, one change to be aware of is that the Labor Commissioner has been directed by the state’s 2024 legislature to create a model whistleblower notice by January 1, 2025, which employers may rely on to comply with existing notice requirements. Previously, the Labor Commissioner had offered a sample notice but there was no guarantee it was compliant. Thankfully the 2024 California legislature passed AB 2299, directing the Labor Commissioner to provide a notice that offers a safe harbor to employers. It’s unclear whether the whistleblower notice that’s posted on the state’s Workplace Postings webpage is the updated version, so we recommend checking back in the new year and downloading the copy at that time.
